If you engage AZDZ.PH Housekeeping and Property Management Services for any of our advertised services you agree to abide by these terms and conditions for both our website and for our services in General.

 

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. "The Company", “Ourselves”, “We”, “Our” and "Us", refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of Philippines. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Customer Reviews

  1. This Agreement shall begin on the date hereof.

  2. AZDZ.PH Respects our clients and their guests privacy.  We may from time to time publish reviews from such websites as www.airbnb.com on our website where our name is mentioned in a positive way.  AZDZ.PH Will not publish the identity nor share the identity of any of our clients on our website or to any third parties at any time.

  3. If you see a review that you think may identify you and you would like us to remove it please do the following -

    1. Contact us and let us know which image it is that you would like removed.

    2. The reason for removal.

    3. AZDZ.PH Respects our clients privacy and will remove any image that you would like us to but we only generally use reviews that are already in the public domain like.   www.airbnb.com shows all reviews to the public so if we use one, we will hide our clients name by blurring it out.  

  4. You hereby grant to www.azdz.ph a non-exclusive royalty-free license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats or media which shed a positive light on AZDZ.PH.

Hyperlinking to our Content

  1. The following organizations may link to our Web site without prior written approval:

    • Government agencies;

    • Search engines;

    • News organizations;

    • Online directory distributors when they list us in the directory may link to our Web site in the same manner as they hyperlink to the Web sites of other listed businesses; and

No use of www.azdz.ph’s logo or other artwork will be allowed for linking absent a trademark license agreement.

Pricing

Without prior consent the prices on our website may change and the prices on our website over-ride any other agreements in place except where a formal agreement has been reached, representatives from our company or sales teams or any contractor we may engage who incorrectly or inadvertently enter into any formal agreement with pricing that is not of the same or higher value than our website shall be deemed to have acted in error or misjudgment and AZDZ Housekeeping and Property Management Services shall not be held accountable or liable for any such contracts signed or verbal agreements made outside of the scope of our current advertised pricing on our website.  Compared to many agencies in Manila we are very competitive but our pricing list is not up for negotiation.   We do however, as advertised offer discounts for volume clients or large one-off jobs.  

Reasonable Condition

Our Housekeeping and Office cleaning rates are based on those which are deemed to be in a reasonable condition.  This means the condo or office must be in a Fair, proper, or moderate state under the circumstances of which a normal condominiums or Offices' level of cleanliness would be considered.  If we attend at your premises for the first time or you are acting on behalf of an agent to have a condo or office cleaned based on our pricing model, then the"Reasonable Condition" test would apply.  Should you have property that an ordinary person similarly circumstanced would deem it not to be in "Reasonable Condition" then it is your duty to disclose this to us upon requesting our services.   We then may or may not choose to follow through with the project and if it is deemed not to be in reasonable condition then extra charges would apply and would be provided to you by way of either written or verbal quotation.  

Content Liability

We shall have no responsibility or liability for any content appearing on your Web site. You agree to indemnify and defend us against all claims arising out of or based upon your Website. No link(s) may appear on any page on your Web site or within any context containing content or materials that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

Reservation of Rights

We reserve the right at any time to withdraw our services to any client for any reason we choose. 

Safety of our staff

We reserve the right at any time to withdraw our services if we believe the working environment for our staff is not safe or potentially not safe.   Sexual harassment, bullying or degrading of any of our staff will not be tolerated and if need be the local Police will be contacted if any of our staff are assaulted, threatened or intimidated by a client or a clients guest. 

Liability of Clients Property and Contents

As part of our service we are entrusted to hold the keys to our clients properties and this is something that AZDZ.PH does not take lightly and this trust and our reputation mean everything to us, so it is very important that our clients understand that we know you are putting your trust in us, and by doing so it is our Promise to you that we will do everything in our power to maintain that trust and protect your investment!  AZDZ.PH takes pride in being the "eyes and ears" on the ground and the guardian of  our clients properties.  We have our name behind our business and are registered with all local departments and have a perfect reputation for security for our clients but we must add this disclaimer to protect ourselves from the potential actions of others.

Given that our clients have many different guests from various walks of life from different countries and backgrounds there is always the possibility of theft or damage to property and this is an inherent risk for all owners renting their investments out on sites like www.airbnb.com and similar, and although there are checks and balances and ID verification processes on these sites, the client is ultimately the person who decides who stays in their condo.   AZDZ.PH Will check your guests ID upon guests check in and check the condo periodically if we are also engaged for housekeeping we will keep a discreet eye on your things and of course let you know if anything is missing or damaged.  

However this does not stop a potential thief getting another set of keys cut, or the clients guest themselves stealing property, or the guest of a guest, and AZDZ.PH has no control over this and it is matter for the clients in-house security and to ensure that their "House Rules" are adhered to by their guest.   

We keep our clients keys locked in a SAFE bolted to the floor with only 2 people knowing the access code, one of them is the business owner Dindo Zacarias and the other is an Australian citizen based in Australia. 

So although all possible precautions are taken by AZDZ.PH to check ID's and inspect properties when checking in guests, check out guests and during housekeeping days, AZDZ.PH accepts NO liability for any items stolen from a clients property at the time of engagement or post engagement.

Should we notice anything missing, particularly anything large or of value we will of course immediately inform the client and then assist them with contacting the local Police and in-house Security should they require us to do so.

Thankfully most of the newer condo's in Manila these days all have CCTV so this lowers the chance of theft considerably.

 

Removal of links from our website

If you find any link on our Web site or any linked web site objectionable for any reason, you may contact us about this. We will consider requests to remove links but will have no obligation to do so or to respond directly to you.

Whilst we endeavor to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up to date.

Responsibility of client to AZDZ.PH with regard to Guests

Azdz.ph is not responsible for nor do we accept any liability for the reviews your guests may leave.   Although the majority of our clients receiving glowing reviews from our services there are some circumstances which are out of our control and we accept no liability when it comes to this.

We endeavor to meet all of our clients needs but it is up to the client to ultimately decide if their guest is of good character and to trust them to reside in their premises.

AZDZ.PH Does not provide any warranty or guarantee of any kind that relates to a clients guests actions either pre, during or post arrival.

It is the sole responsibility for the client to allow enough time in-between guests checking out and guests checking in to allow AZDZ.PH enough time to clean the place prior to the next guest.

AZDZ.PH Reserves the right to not attend and clean a premises without having sufficient notice of at least 48 hours but in most cases we can arrange something with as little as 24 hours notice.

We will do our best to accommodate any request from our clients but we need to make it clear that at least 48 hours notice is required, if we can work something in outside of that time frame we will happily do so.

Airbnb Co-Hosting Terms and Conditions

Azdz.ph is not responsible for nor do we accept any liability for the guests that stay at your condominium.   We, as part of the agreed service will vet the potential guests according to your instructions, and provided you with the detail of the prospective guests for your final approval.  By giving this final approval you agree not to hold AZDZ.PH nor any of it's staff liable for any misconduct or damages incurred by said guests.  

 

Should you waiver the right/need to personally approval all guests for Co-Hosting, you also agree that you alone are responsible for your guests actions.   AZDZ.PH undertakes to review/screen and vet any potential guests upon your behalf but if you guest(s) break any of the house rules, the property rules or causes any loss or damage to yours or anyone else's belongings AZDZ.PH is not financially liable in anyway as this would be considered unforeseen circumstances, which are beyond our control.    

We endeavor to meet all of our clients needs but it is up to the client to ultimately decide if their guest is of good character and to trust them to reside in their premises.

AZDZ.PH Does not provide any warranty or guarantee of any kind that relates to a clients guests actions either pre, during or post arrival.

We will advise you if we think a guest is not suitable and the reasons why, we will also note, photograph and record any damages or comments made by any guests who are staying at your residence either as a co-host or as a general guest.  

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

  1. limit or exclude  your liability for death or personal injury resulting from negligence;

  2. limit or exclude your liability for fraud or fraudulent misrepresentation;

  3. limit any of your liabilities in any way that is not permitted under applicable law; or

  4. exclude any of your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
